Welcome to Salvek, operated by Lynden-Blaine Technologies Inc. (“Salvek,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Salvek website, mobile application, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately stop using the Service.

1. Eligibility
 

• You must be at least 18 years old to use the Service.

• You represent that you have full legal capacity to enter into binding contracts.

• We may, at our discretion, require identity verification at any time.

• Accounts created with false, misleading, or incomplete information may be suspended or terminated.
   

2. Account Registration
 

• To access certain features, you must register an account. You agree to provide true, accurate, current, and complete information.

• You are solely responsible for maintaining the confidentiality of your login credentials.

• You agree to notify us immediately of any unauthorized use of your account.

• We are not liable for any loss arising from unauthorized account access caused by your negligence.
   

3. Use of the Service

You agree to use the Service only for lawful purposes and in compliance with these Terms. You may not:

• Post false, misleading, fraudulent, or defamatory content.

• Sell or attempt to sell stolen, illegal, unsafe, or prohibited goods.

• Interfere with the Service, including introducing viruses, bots, or scraping data.

• Circumvent security features or abuse the platform in any way.

• Engage in harassment, threats, discriminatory conduct, or abuse toward other users.
  Violation of these rules may result in account suspension or permanent ban.
   

4. Listings and Content

• Sellers are solely responsible for the accuracy, legality, and completeness of their listings.

• Photos and descriptions must represent the item truthfully. Misrepresentation is prohibited.

• Listings must comply with all applicable laws, including but not limited to consumer protection, salvage vehicle regulations, tax obligations, and intellectual property laws.

• We may remove or modify listings at our discretion.
   

5. Transactions
 

• Salvek provides a marketplace platform but is not a party to transactions between buyers and sellers.

• Buyers and sellers are solely responsible for their agreements, including delivery, payment, and condition of items.

• Salvek does not guarantee the safety, quality, legality, or delivery of any goods.

• Disputes arising from transactions are the responsibility of the parties involved.
   

6. Fees and Payments
 

• Registration may be free, but certain features, tools, or services may incur fees.

• All applicable fees are disclosed prior to purchase.

• Unless otherwise specified, fees are non-refundable.

• Users are responsible for applicable sales tax, import duties, and governmental charges.

• If you fail to pay fees owed, we may suspend or terminate your account.
   

7. Prohibited Items

The following may not be listed or sold:

• Stolen or counterfeit items.

• Vehicles without valid documentation where required.

• Firearms, explosives, hazardous materials, or items restricted by law.

• Content that infringes intellectual property rights.

• Any item prohibited by local, state, federal, or international law.
   

8. Communication Between Users
 

• The messaging system must only be used for communication directly related to listings.

• Sharing false, abusive, discriminatory, or harassing content is strictly prohibited.

• We may monitor or review messages if flagged for violation of these Terms or applicable laws.
   

9. Intellectual Property
 

• All rights, title, and interest in the Service (including logos, trademarks, software, databases, and design) are owned by Lynden-Blaine Technologies Inc.

• Users retain ownership of the content they post but grant Salvek a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, and distribute such content in connection with the Service.

• Unauthorized use of Salvek’s intellectual property is strictly prohibited.
   

10. User Conduct and Responsibilities
 

• You are responsible for all activity under your account.

• You must not engage in fraud, scams, or unlawful conduct.

• You agree to comply with all applicable laws regarding buying, selling, and advertising.

• You must respect other users and refrain from abusive, offensive, or threatening behavior.
   

11. Privacy

• Use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

• By using the Service, you consent to the collection and use of your data in accordance with that policy.
   

12. Termination of Accounts

We may suspend or terminate accounts if:

• You violate these Terms.

• You engage in illegal or fraudulent activity.

• You harm or attempt to harm Salvek, its users, or its reputation.
  Users may terminate their account at any time, but obligations regarding payments or disputes may survive termination.
   

13. Disclaimer of Warranties

• The Service is provided “as is” and “as available” without warranties of any kind.

• We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

• We do not guarantee that items listed will be safe, legal, delivered, or as described.
   

14. Limitation of Liability

To the maximum extent permitted by law:

• Salvek is not liable for any indirect, incidental, consequential, or punitive damages.

• Salvek is not liable for loss of profits, data, reputation, or goodwill arising from your use of the Service.

• Our total liability for any claim is limited to the amount you paid to Salvek in the 12 months preceding the claim.
   

15. Indemnification

You agree to indemnify and hold harmless Salvek, its officers, employees, affiliates, and agents from any claims, damages, liabilities, or expenses (including reasonable legal fees) arising out of:
 

• Your use of the Service.

• Your violation of these Terms.

• Your infringement of third-party rights.
   

16. Disputes and Governing Law
 

• These Terms shall be governed by the
  laws of British Columbia, Canada, without regard to conflict of law principles.

• Any dispute shall be resolved exclusively in the courts of British Columbia, Canada.

• Users agree to submit to the jurisdiction of these courts.
   

17. Modification of Terms
 

• We reserve the right to amend these Terms at any time.

• Updates will be posted with a revised “Effective Date.”

• Continued use of the Service after modifications constitutes acceptance of the revised Terms.
   

18. Miscellaneous
 

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Salvek.

• Severability: If any provision is found invalid, the remainder remains enforceable.

• No Waiver: Failure to enforce any provision does not constitute a waiver.

• Assignment: You may not assign your rights without our prior consent. We may assign our rights at any time.

• Language: These Terms are drafted in English. Translations may be provided for convenience, but in case of conflict, the English version shall prevail.
